SCOPE OF PRIVACY POLICY

Locker Live Inc. ("Locker," "we," "us," and "our") is committed to protecting your privacy in conjunction with the use of its website and mobile app (collectively, the "Site"). This Privacy Policy ("Privacy Policy") describes, among other things, the types of personal information collected about you when you visit our Site, how your personal information may be used and disclosed, how you can control the use of your personal information, and how your personal information is protected. It shall be interpreted in conjunction with our Terms of Service. By using our Site, you consent to the worldwide, perpetual collection, transfer, manipulation, storage, disclosure and other use of your personal information as described in this Privacy Policy. Please note that any content you submit via our webpage which is personal information may be used, disclosed and retained by us in accordance with the terms of this Privacy Policy. If you have a question about how your personal information is being used, you can contact us through the methods provided in the "QUESTIONS ABOUT THIS PRIVACY POLICY" section at the end of this Privacy Policy.

WHAT DO WE MEAN BY "PERSONAL INFORMATION" AND "PERSONAL DATA"?

"Personal information" or "personal data" is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. Personal information that is publicly available, aggregated (e.g., compiled to create statistics that cannot identify a particular individual) or de-identified (stripped of all unique identifiers such that it cannot be linked to a particular individual) is not considered "personal information" for the purposes of this Privacy Policy.

PERSONAL INFORMATION COLLECTED BY US AND ITS USE

You are not generally required to provide personal information about yourself when you visit our Site. However, should you wish to register for certain services, access certain content, or directly contact the Site, you may be asked for some or more of the following information:

  • Contact information, such as your name, email address, postal address, zip code, phone number, and other related information
  • User name, password, and password hint questions
  • Location/domicile
  • Age and date of birth
  • Other demographic information such as gender and job information
  • Information for maintaining a public profile
  • Preferred means of communication
  • Information related to any other correspondence you send to us

In addition, d you wish to use certain of our services, you may be asked to provide the following:

  • Payment verification information, such as credit or debit card number, security code and date of expiration
  • Social security number or comparable national identifier
  • Other information as related to processing your payment and confirming your payment information, age and location, such as a photo of your driver's license

Finally, should you win any of our contests, you may be asked to provide the following:

  • Relevant information about yourself needed to assist us in marketing future contests

Information required to remit payment to you, such as your digital wallet information

  • Information required to provide the proper tax forms related to your winnings

PERSONAL INFORMATION COLLECTED AUTOMATICALLY

The following personal information may be collected automatically from all visitors to the Site by either us or third parties acting on our behalf and may be used for internal customer tracking and business purposes, as well as any other purposes to support our business and comply with matters of law:

  • Your browser type and operating system
  • Your Internet Protocol ("IP") address
  • Sites you visited before and after visiting our Site
  • Web pages and advertisements you view and links you click on from our Site
  • Other unique identifiers, including mobile device identification numbers that can identify the physical location of your device in accordance with applicable law
  • Information collected through cookies, web beacons and other technologies
  • Standard server log information
  • Other information collected naturally by Google Analytics and similar programs

Our Site may employ a geo-tracking feature to ensure you are located in a state where it is legal to use our service. This location data is never stored, and is discarded as soon as the determination is made.

Cookie providers, such as advertising companies, may gather personal information about your visit to the Site or other websites to enable them to market products or services to you, to monitor which ads have been served to your browser and which webpages you were viewing when such ads were delivered. Depending on the particular advertising services they provide, third-party advertising companies may employ first-party cookies or third-party cookies.

  • Google Analytics: To help facilitate the delivery of relevant content, we use Google Analytics. These services use cookies to report on user interactions on our and others' websites. We use the information collected for optimizing marketing, refining advertising, and/or programming strategies, and generally improving user experience. Note that this opt-out is specific to Google activities and does not affect the activities of other ad networks or analytics providers that we may use.

If you prefer to prevent third parties from setting and accessing cookies on your computer, you may set your browser to block cookies. You will need to do this for each browser and each device you use. Although this may provide you with enhanced anonymity, it may affect the functioning of our Site. For example, blocking cookies on the Site may result in your browser not remembering log-in information or other preferences. Additionally, you may remove yourself from the targeted advertising of companies that participate in the Network Advertising Initiative 3 | Page by opting out here, or of companies participating in the Digital Advertising Alliance program by opting out here.

HOW WE STORE YOUR PERSONAL INFORMATION

We will store your email address, telephone number and user name in our backend database for so long as you maintain an active account. This same data is also stored in the mobile application on the device from which you access the app.

Your residence address, city, state, zip code, date of birth, first name, and last name are encrypted and stored in our backend database for so long as you maintain an active account. We retain this information as part of our identity verification for the user.

Although you will be asked to provide credit or debit card information to use certain of our services, this data is not collected by us, but is sent directly to our banking vendor, Approvely. This information does not pass through our code or databases, and we do not store any payment card information on any of our systems. Approvely issues an anonymous token that represents your PCI. We store that token in our encrypted backend database, so long as a user maintains an active account, so that we can conduct transactions with the user. It is your obligation to update your payment card information, in the event of a change, to avoid uninterrupted use of our service.

We also do not store the photo you provide of your driver's license. This image is sent directly from our backend to our identity verification vendor, TSEVO, to verify that the document is valid and to scrape data from it. We discard this image immediately after transmission to TSEVO. If TSEVO successfully verifies your identity, they will send back the following information, scraped from your driver's license:

  • Residence address, including: city, state, zip code
  • Date of birth
  • First and last name

This data is then stored in our encrypted backend database, so long as a user maintains an active account, next to your manually inputted values for the same fields. We retain these as proof of our identity verification for the user.

HOW WE SHARE AND DISCLOSE YOUR PERSONAL INFORMATION

We only use payment and identity verification information (such as credit card numbers, driver's license numbers and social security numbers, or comparable national identifiers as necessary): for completing particular transactions; if we believe that it is reasonably necessary to comply with a law, regulation or legal request; to protect the safety of any person; to protect the intellectual property rights of others; to address fraud, security or technical issues; or to protect our rights or property.

All other personal information collected about you may be used for a wide range of other purposes, including to fulfill requests for services, to enable you to participate in contests and polls, to analyze the demographics of our customer base, to customize content and advertising to you, to improve our services, to contact you when you have opted in to receive certain messaging, to respond to and address customer service requests, to market our brand, contests and winners, to share with actual and potential sponsors for joint marketing purposes, to share with, or sell to, third parties to the extent permitted by law, to prevent potentially prohibited or illegal use of our Site and services or use of our Site and services in a manner that would violate the Terms of Service, and for any other purpose disclosed to you, or reasonably known by you, at the time we collect the personal information.

Optional Contact Book Integration

If you are a Commissioner creating a League Contest you may be presented with the choice of connecting the contacts stored in your device ("Contacts") with the Site (this process being "Contact Book Integration"). Contact Book Integration allows the Commissioner to review his or her Contacts on the Site and initiate SMS messages to selected Contacts with an invitation to become a Participating User in the League Contest (each such message being a "League Invitation"). By utilizing Contact Book Integration to send League Invitations, you (a) acknowledge and agree that you, and not Locker™, are the party responsible for initiating the transmission of the League Invitations and (b) represent and warrant that you have obtained any and all permissions and consents required under applicable law to initiate the transmission of League Invitations to the applicable Contacts.

INTERNATIONAL DATA TRANSFERS

Our Site is hosted in the United States and is intended for and directed to users in North America. If you choose to provide us with personal information, it will be stored in the United States ("US") and may be stored in other jurisdictions. Locker may transfer that personal information to its third-party service providers, affiliates, and subsidiaries, across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting the Site from the European Union ("EU") or other regions with laws governing data collection and use, please note that your personal information is transferred to the US and may be transferred to other jurisdictions. The US does not, and these other jurisdictions may not, have the same data protection laws as the EU and other jurisdictions, and may not afford many of the rights conferred upon data subjects in the EU and other jurisdictions. Accordingly, your personal information may be accessible to foreign courts, law enforcement, and national security entities in such countries. With knowledge of these risks, you acknowledge that:

  • Your personal information may be used for the uses identified above in accordance with this Privacy Policy; and
  • Your personal information may be transferred to the US as indicated above.

DATA SECURITY

The security of your personal information is important to us. We implement reasonable technical and organizational security measures to protect the personal information submitted to us, both during transmission and once it is received. Locker takes steps to ensure that such data remains private and confidential. We restrict access to personal information to Locker employees, contractors, and agents who need to know that information in order to operate, develop, or improve our Site. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Please understand, however, that no data transmissions over the Internet can be guaranteed to be 100% secure due to the inherent risks of data transmission over the Internet. Consequently, we cannot ensure or warrant the security of any information you transmit to us, and you understand that any information that you transfer to us is done at your own risk. If we learn of a security system breach, we may attempt to notify you, including electronically, so that you can take appropriate protective steps. By using the Site or providing personal information to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Site. We may post a notice via our Site if a security breach occurs. We may also send an email or postal mail to you at the email address you have provided to us in these circumstances. CHILDREN'S DATA

Our Site is not for the use of individuals under the age of 18, and our contests and similar offerings are age-restricted in accordance with applicable law. If we learn that we have collected personal information from anyone under these ages, we will delete that information as quickly as possible. If you believe that we might have any information from someone under these ages, please contact us at contact@locker.bet. In those instances where Locker™ has actual knowledge that it has collected information from an individual under these ages, we will comply with all applicable laws including, as applicable, the U.S. Children's Online Privacy Protection Act.

CHAT FEATURE AND SESSION REPLAY TECHNOLOGY

We may use session replay technology offered by third parties to monitor how you interact with our Site. The personal information collected by this technology may include, without limitation, which links you click on, pages and content you view, information that you type into our online forms and chat features, recordings of mouse clicks and movements, and information about your device or browser. Our Site may also have third-party chat features for support purposes. These features may collect the content of your communications and other personal information you provide while interacting with the chat feature. Please discontinue use of the Site if you do not consent to the collection of such information by us and third parties.

DISCLAIMER REGARDING VIDEO CONTENT

The Site may contain video content, audiovisual content, or content of a like nature (collectively, "Video Content"). In connection with our provision of Video Content, the Site may utilize online tracking technologies and code-based tools, including, but not limited to, Software Development Kits ("SDKs") and cookies (i.e., advertising or analytics cookies) that track information about your activity and webpage-viewing history on the Site (collectively, "Tracking Tools"). Tracking Tools on the Site may result in information about your activity on the Site being transmitted from your browser to Locker and third parties, which, in turn, may result in the display of targeted advertisements on third-party websites and platforms, including advertisements for Locker content. In addition, whether Tracking Tools on the Site results in your browser's transmission of information to third parties depends on a number of factors that may be outside of Locker's knowledge or control, including what third-party websites you use, what information you have provided to such third parties, and whether (and the extent to which) you have limited the use of cookies by the operators of those third-party websites.

PASSWORD PROTECTION

We are committed to protecting your personal information. All password protected sections of the Site are encrypted with standard security measures. All user profiles and payment screens are password protected.

YOUR PRIVACY RIGHTS

If you choose to share personal information with us, you may have the opportunity to update that information on our Site or by contacting us at the following address: contact@locker.bet. If you ask us to shut down your account or delete your personal information, we will disable your account within a reasonable period of time. Please note, however, that we may retain certain personal information about you to satisfy both our legal and security obligations. For example, some of your personal information may remain in backup storage even if you ask for it to be deleted. In some cases you may be entitled under local laws to access or object to the processing of personal information that we hold relating to you.

Opting Out of Marketing Communications

You may sign-up to receive email or newsletters or other communications from us. If you would like to discontinue receiving this information, you may update your email preferences by using the "Unsubscribe" link found in emails we send to you or by contacting us via the contact information below. If you unsubscribe, you may still receive transactional or other relationship emails from us.

Responding to Browser DNT Signals

Some browsers offer a "do not track" ("DNT") option. Because no common industry or legal standard for DNT has been adopted by industry groups, technology companies, or regulators, we do not respond to DNT signals. We will make efforts to continue to monitor developments around DNT browser technology and the implementation of a standard.

Specific State Rights

Residents of the states of Nebraska and Texas may have the following additional rights:

  • The right to opt out of "sales" of personal information and use of your personal information for "targeted advertising," as those terms are defined under applicable law.
  • The right to opt out of "profiling" under certain circumstances, as defined under applicable law
  • The right to access and the right to confirm processing of your personal information under certain circumstances.
  • The right to obtain a copy of your personal information in a portable and, to the extent technically feasible, readily usable format.
  • The right to correct personal information under certain circumstances.
  • The right to delete personal information under certain circumstances.

For residents of Nebraska and Texas, an authorized agent such as another individual or business may submit a request on your behalf. We will not discriminate against you for exercising your rights under applicable law

We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

We must verify your identity before responding to your request. We may verify your identity by asking you to provide personal identifiers that we can match against information we may have collected from you previously. We may need to follow up with you to request more information to verify identity. We will not use personal information we collect in connection with verifying or responding to your request for any purpose other than responding to your request.

Residents of Nebraska and Texas have the right to appeal a denial of their request by contacting us as described in the notice of denial.

California "Shine the Light" Law

California Civil Code Section 1798.83 permits visitors to the Site who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share personal information with third parties for their direct marketing purposes.

Disclosure for Nevada Residents

Residents of Nevada have the right to opt out of the sale of certain personal information to third parties. We currently do not sell your personal information as defined by Nevada law.

USERS IN THE EUROPEAN ECONOMIC AREA

We process "personal data," as that term is defined in the European Union's General Data Protection Regulation ("GDPR"). If you are located in the EEA, U.K., or Switzerland, you may have the following rights:

  • The right to access information about the categories of personal data we have collected about you. You may also request a copy of the personal data we have collected, and upon request, we will provide this information to you in a machine-readable electronic format or transfer it to a third party.

  • The right to obtain information about, and a copy of, the safeguards we use to transfer personal data across borders.

In processing personal data, we may rely upon the following lawful bases:

  • Consent. We may process personal information with the consent of the individual whose data is being processed and/or in reliance upon the consent of the administrator of the account, who must affirm that s/he has obtained appropriate consent from all participants.
  • Contract. When we enter a contract with you and/or an administrator for your account, we process personal information on the basis of our contract in order to prepare and enter into the contract, as well as to perform and manage our contract. This is necessary for us to provide the Websites to you.
  • Vital interests. In a case where the personal information is required to protect your vital interests or the vital interests of another natural person, then this may be used as the lawful basis of the processing. For example, we may need to process personal information in the event of a pandemic.
  • As required by law. We may process personal information as required to comply with legal obligations to which we are subject for the for the purpose of compliance with EEA, UK, or Swiss public, governmental, judicial, or other regulatory authorities.
  • For legitimate business purposes. This includes but is not limited to legal compliance and the purposes described above.

Users who are located in the European Economic Area ("EEA"), the U.K., or Switzerland may also have the right to lodge a complaint about our data collection and processing actions with the relevant supervisory authority in their country of residence. USER GENERATED CONTENT

Certain aspects of our Site may enable users to submit their own content for contests, blogs, message boards and other function. Publication of any such content is subject to our Terms of Service. Please remember that any information you disclose, as well as any video and audio images you provide, becomes public information and thus you should exercise caution when considering what information to disclose in this manner. We cannot necessarily prevent such information from being used in a manner that may violate this Privacy Policy, the law or your personal privacy and safety

THIRD-PARTY SITES

This Privacy Policy applies solely to personal information collected on the Site. The Site may contain links to other websites. When you select a link to a third-party website (for example, if you link to PayPal in order to pay for a service or product), you will be leaving our Site. Any information that you disclose to a third-party site will be governed by that site's privacy policy. We are not responsible for the privacy practices or the content of these other websites. MERGER, ACQUISITION, SALE, OR BANKRUPTCY

In the event that Locker™ is involved in a merger, acquisition, sale, bankruptcy, or other reorganization related transaction (e.g., insolvency, reorganization, assignment for the benefit of creditors, or any other transaction changing either ownership or control of the company), there may be a disclosure of your personally identifiable information to another entity that is related to that transaction or event. We cannot control the manner in which that information is treated, transferred, protected, or used by such other entity.

CHANGES TO THIS PRIVACY POLICY

We may change this Privacy Policy pursuant to the procedures outlined in our Terms of Service. Unless otherwise noted, our current Privacy Policy applies to all personal information that we have about you and your account. If we make changes to this Privacy Policy, we will notify you by publication here. By continuing to access or use the Site after such changes take effect, you agree to be bound by the revised Privacy Policy.
